1. INTRODUCTION
We undertake to protect your privacy and to process your personal data in a transparent, secure and legal manner.
Vitamin Well Schweiz GmbH (hereinafter the “Company”, “we”, “us” or “our”) will process your personal data when you visit and use the services provided at barebells.ch (hereinafter the “Website”) or otherwise interact with us as stated herein. Below you can find information about what type of personal data we process, why we do it, what we use the data for and how we can share it, and what rights you have as a Data Subject. If you provide us with personal data of other persons (e.g. for gift giving purposes or if you are acting on that persons behalf, please only do so if you are authorized to do so in accordance with the applicable data protection laws and only if the other person agrees to you providing us with their personal data for the purposes of data collection and processing in accordance with our privacy policy.
This privacy policy applies insofar as the processing activities are not subject to other privacy policies or are provided for by applicable law. Please read this privacy policy carefully. By purchasing our products and using our services, you consent to the collection and processing of your personal data in accordance with this privacy policy.
Vitamin Well Schweiz GmbH, which is the Website's publisher, is as Swiss company with share capital of CHF 100'000.00, whose registered office is located at Hardturmstrasse 3, 8005 Zürich, with company number CHE-231.253.087.
Respecting your privacy and your personal data is a priority for the Company which is committed to processing your data in compliance with the Swiss Data Protection Act (SR 235.1)and the General Data Protection Regulation (EU) 2016/679 of April 27, 2016 (hereinafter "GDPR") where applicable, and any other applicable local laws, and the related standards and recommendations issued by the Swiss Data Protection Authority (“FDPIC”) and the European Data Protection Committee (“EDPB”) or other competent authorities whose decisions, guidelines or standards apply(together, the "Applicable Regulation"). The GDPR has established itself worldwide as the standard for strong data protection. However, whether and to what extent the GDPR applies depends on each individual case.
The Company is the data controller for all processing of your personal data, unless otherwise stated in this privacy policy (hereinafter “Privacy Policy”).
We will only use your personal data for the purposes, on the legal grounds and for the retention periods specified below.
The Company acts as a data controller for all data collected through the Website, via any other means, or when you enter into a contractual relationship with the Company.
If you wish to exercise any of your rights under the Applicable Regulation and as mentioned in Section 8 of this Privacy Policy, you may contact the Company by any of the means provided below, specifying your identity and the precise purpose of your request (you may be asked to provide proof of your identity if we are unsure of the same).

2. WHAT IS PERSONAL DATA?
Personal data is any information that is directly or indirectly linked to a natural person (“Data Subject”), i.e., any type of information that may be associated with an individual. Some examples are names, email addresses, online identifiers, or phone numbers if they can be linked to a particular living physical person, but also for example, a photo in which the person can be recognised.
3. WHAT DOES “PROCESSING” OF PERSONAL DATA MEAN?
In principle, the term “processing” includes all types of action that is possible to take with personal data. The definition is very broad and includes all forms of data handling from collection, registration, retention/storage and adaptation to use, sharing and even deletion of personal data.
4. WHAT PERSONAL DATA DO WE PROCESS, FOR WHICH PURPOSES AND ON WHAT LEGAL GROUNDS?
We process personal data in order to fulfil or enter into an agreement with you in relation to the following circumstances:
- Purchase of products or services. If you purchase products or services from us, we will process your personal data in order to fulfil our contractual obligations to you.
- Relevant personal data is first name and last name, delivery address/invoicing address, telephone number, email address, order information, payment information, payment history, credit card information and payment reference number.
- Participation in events. If you have agreed to our terms and conditions for participation in an event organised by us, you will have provided us with personal data such as:
- Contact details (e.g., name, address, email address and phone number) and possibly also health information (e.g., injuries or allergies).
We need this information to organise and host the event in a safe manner. If you provide us with health or other information we will also ask for your explicit, specific and informed consent for such processing. Because we take photos and films during our events for future marketing purposes, as agreed in the terms and conditions we may also collect, edit and distribute photos and films on social media in which you are visible and identifiable subject to your signature of an express individual consent to exploit your image unless you showed yourself in a conspicuously public position on the occasion of those events).
- Participation in prize drawings. If you choose to participate in a prize drawing or competition that we arrange, you will have provided us with personal data such as:
- Your name, delivery address, phone number, email address, social media handle, age and possibly a contribution (e.g., a photo or film) in which you can be identified. We use this information to complete the prize drawing/competition (e.g., for identification and age checks or to select a winner and for distribution of the relevant benefit or prize) and in some cases, also as the basis for further prize drawings/competitions.
With your consent, further compatible use of such information may also be stated in the terms and conditions and the information we provide before the competition. If the prize is a trip, we may also process information such as:
- Citizenship and health information (e.g., allergies) that we need to know for safety reasons. If you do not want us to process personal data for the above purposes, we cannot organise your participation in the above drawings or competitions.
- Sponsorship, etc. If you have entered into an agreement with us regarding sponsoring an event, manufacturing of products or other professional collaboration, you will have provided us with personal data such as your contact details (e.g., name, address, telephone number, title and employer). We use such data in order to be able to fulfil our agreement with you. If you do not want us to process personal data for the above purposes, we cannot fulfil the agreement.
The legal basis for our processing of personal data described above is either your consent or that the processing is necessary in order to enter into or fulfil an agreement with you. However, certain processing may take place on the basis of our legitimate interests, where your consent is not collected or where we do not prepare entry into nor enforce an agreement directly with the Data Subject or when the purpose is not directly linked to this preparation or enforcement of an agreement. Then, we process this personal data based on our assessment that it is necessary for our legitimate interest in marketing our products and brands, to remain competitive as a company, for our internal business management and organisation or to conduct our business in a safe manner. In this case, we consider that our legitimate interest is not overridden by your interest or fundamental rights and freedoms that require protection of personal data, as we process the data for purposes that should be in line with your expectations.
We will process personal data based on our legitimate interests:
- Participation in events. If you participate in an event or trip that we arrange, and you provided us with details such as:
- Your contact details (e.g., name, address, phone number and email address).
- As it is common to take photos and films for publicity and marketing purposes at these events, we may also process such material in which you can be identified (subject to your signature of an express individual consent to exploit your image unless you showed yourself in a conspicuously public position on the occasion of those events).
- Customer Service. If you request customer service from us via our support channels, we will process your personal data in order to assist you with the relevant matter (i.e., your name, email address and other contact details, order details, purchase amount, purchase history, invoice, payment method, our correspondence with you, technical information about devices and operating systems used).
- Questions and complaints. If you have contacted us with questions or complaints about our products (not based on an agreement with you), you may have provided us with personal data such as your name, address, email address and phone number. We use this data to answer your questions, investigate product issues, track or report health risks, compensate you when required and prevent fraudulent behaviour, for example through unfounded complaints and claims for compensation.
- Contacting us on your own initiative. If you choose to contact us following our general invitation or on your own initiative via one of our general email addresses, with ideas about new flavours, products or promotions or other comments, you provide us with personal data that we use to answer and evaluate the content of your email or if you apply for a job with us.
- If it is necessary to protect our rights, as we have a legitimate interest in establishing, exercising and defending legal claims.
- If we sell or otherwise dispose of parts of our business and/or our assets.
We process this personal data based on our assessment that it is necessary for our legitimate interest in marketing our products and brands, to remain competitive as a company, for our internal business management and organisation or to conduct our business in a safe manner. In this case, we consider that our legitimate interest is not overridden by your interest or fundamental rights and freedoms that require protection of personal data, as you have provided us with your personal data yourself on your own initiative and we process the data for purposes that should be in line with your expectations.
If we have entered into an agreement regarding any of the activities listed above and the processing of your data is necessary for the enforcement of this agreement, our processing of associated personal data will instead be based on the fulfilment of that agreement.
We will process personal data based on legal requirements and claims, public interest and consent:
We may need to process your personal data in order to meet statutory requirements (e.g., requirements to keep records or in our reply to a request of yours to exercise your individual rights) and by order of the courts or public authorities (e.g., for tax reasons). We may also be required by law or forced by public interest to process personal data relating to product problems in order to facilitate tracking and monitoring of potential health risks. We may also process your personal data, such as bank account information, workplace, health information (such as allergic reactions or other health information that you provide to us) to determine, enforce or defend legal claims.
In addition, we may process your personal data based on your consent. In such cases, we will obtain your consent in advance for a specific purpose and will ensure that it is provided voluntarily, specifically, informed, expressly and unambiguously. You have the right to withdraw your given consent at any time and are welcome to adjust your position on privacy here, or contact our Data Protection Officer (“DPO”) at dpo@vitaminwell.com or refer to the contact details below. Note that the withdrawal of consent will not apply retroactively to processing that has already been implemented.
- News, invitations, etc. If you register to receive news, invitations and offers (direct marketing), we will process your personal data (such as your name, phone number, address and email address) in order to provide the services you have signed up for. We use this information to send you relevant news and communications, for example via email. In every communication you receive from us, you may choose to unsubscribe from future news and communications. Our direct marketing may be based on profiling, which means that we may tailor the information you receive from us based on certain characteristics. We use the following types of personal data to create such a profile: your gender, your location, your previous purchases, your behaviour on our website and/or your previous behaviour when receiving our direct-marketing communications (if we have collected such data). This may also mean that we send you reminder emails about products you have left in your shopping cart, provided that you have accepted the relevant cookies required for this. Categories of personal data include all data collected in connection with a purchase (see above), your email address, your location (based on the company website you used to sign up for our marketing communication), any communication sent to you, your order history, as well as the emails you have opened or clicked, and your interactions with our Website when you have clicked a link contained in emails sent to you.
- Advertising to Existing Newsletter Subscribers and Customers: If you (i) sign up to receive news, invitations, and offers (direct marketing), and/or (ii) are an existing customer who, during the checkout process, has actively consented to receive marketing communications, we may share your email address, name, postal code, country and phone number with our marketing partners (such as Google and Meta) with the purpose of displaying our marketing content to you when you visit their platforms (e.g. Google Search, Gmail, YouTube, Facebook, Instagram, and Audience Network) and/or to exclude you from such advertising. Google and Meta process this data only in a hashed and de-identified form, and solely for the purpose of matching personal data to enable us to target our campaign advertisements to you. This may also include creating ‘lookalike’ or ‘similar’ audiences, allowing our marketing partners to identify other users on their platforms with similar characteristics. - Optional Birthday Information. If you are an active subscriber to direct marketing from us and you choose to provide your date of birth when prompted, we will use this information solely to send you special birthday-related offers and promotions. Providing your date of birth is voluntary and will not affect your subscription.
- Customer reviews. If you have made a purchase and are an active subscriber to direct marketing from us, we may contact you to invite you to review or rate your experience with our products or services. Participation is entirely voluntary, and we process such data to improve our products and customer experience. If you choose to submit a review, you consent to your name and review being publicly displayed on our brand websites and potentially used for marketing purposes to promote our products. Reviews are collected and managed through our external review partner, and by submitting a review you agree to the separate terms and privacy policy applicable to that partner.
- Cookies and similar technologies.
- If you visit the Website and accept our cookies, we may collect personal data in the form of online behavior (e.g. data: IP-address, user generated data from cookies (e.g. clicks, page viewed, page visits, time spent, products viewed and clicked on, orders, average order value), geographic location (country only), correspondence and feedback relating to our products and services, technical data (e.g. language, IP-address, device type, browser settings, time zone, operating system, platform), information about how you have interacted with us, i.e. how you have used our services, response times, page errors, how you reach and how you leave the site etc.) as described in our Cookie Settings. We analyze this information on an aggregated and pseudonymized level for statistical purposes, optimization of our homepage to market our products and trademarks by analyzing what parts of our homepages are most often visited. However, in relation to strictly necessary cookies, our processing is necessary for our legitimate interest in being able to provide you with a functioning website when you visit and use the services provided at the Site.
- If you visit the Website and consent to our cookies for personalised advertising, we will use the data collected (IP-address, user-generated data from cookies, for example: clicks, displayed page, page visits, products displayed and clicked on, orders, average order value, approximate geographical location), for targeted advertising on third-party social media and search engine platforms such as Meta, Google, YouTube, TikTok, etc. The purpose is to present you with advertising targeted at you based on your behaviour and browsing patterns, based on your interaction with our Website and the data collected about you by the operators of those platforms, at specific points in time and locations for these platforms to increase the effectiveness of our advertising campaigns. Your personal information is shared with such third parties to target advertising on their platforms. They will try to match your profile in their database to determine the optimal time and location (the page on which you are browsing) to display an advertisement from us, or to identify other users of those platforms to whom we may want to target ads on those platforms. Third party platforms use tracking technologies to identify when a user of their platform has visited our Website after being presented with one of our advertisements on that platform, and provide us with reports to that effect. This allows to assess the effectiveness of our advertising on those platforms. If you do not accept that we track your data for this purpose you can still see our advertisements on other platforms randomly. - Conversion and advertising tracking: We use features from external platforms to measure and improve our advertising and conversion analysis. This may include features from Google (such as Google Analytics Enhanced Conversions and Google Ads Enhanced Conversions) and Meta (such as Automatic Advanced Matching and Conversions API). With your explicit consent, information relating to events and interactions on the Website—such as completed purchases, conversions, order value and other non-sensitive, transaction-related data – may be shared with these providers for the purpose of measuring, analyzing and optimizing advertising effectiveness and conversion reporting. Such processing takes place after you have provided your consent via our cookie and consent management solution.
5. WHO ARE THE RECIPIENTS OF THE PERSONAL DATA AND TO WHICH COUNTRIES IS IT TRANSFERRED?
Only the parties that need to process personal data for the purposes mentioned above will have access to your personal data. We may need to share your personal data with the internal marketing, commercial, administrative financial, compliance, legal and other competent services of our group companies involved in the processing of your data for the purposes listed above.
The Company currently has sister companies in Norway, Denmark, the United Kingdom, France, Germany, Austria, Spain, Netherlands, Italy, Belgium and the United States, as well as a sister branch office in Finland and is continuing to expand internationally. The Company’s parent company is based in Sweden. We may also work with partners in many countries both within and outside the EEA and may therefore also need to share personal data, for example with service providers and legal advisers that are not based in the EEA.
This means that your personal data may be transferred outside the EEA. When possible, such transfers will be based on decisions from the European Commission or other competent local authorities regarding adequate security levels and otherwise primarily on the execution of an agreement that has been concluded between us. In other cases, any transfer of your personal data to third countries will depend on adequate safeguards such as standard contractual clauses. In exceptional cases we can also perform such transfers based on your explicit consent, important reasons of public interest, the handling of legal claims or in order to protect either your vital interests or those of someone else.
When and to the extent necessary, your personal data is processed by Company employees of our marketing, commercial, administrative financial, compliance, legal and other services and their advisers, suppliers, service providers, partners and distributors having a need to access the data for the relevant data processing services and to the sole extent required by the same. For example, our e-commerce team will have access to personal data related to your purchases and our product managers will primarily have access to incoming questions and complaints about our products.
The Company enters into Data Processor Agreements with third parties that have access to or process personal data on our behalf, either through their services or our collaboration. We therefore ensure that the third parties with whom we work process data in the same legal and secure way as we do. More specifically, personal data is shared with the following categories of service providers that process such data on our behalf:
- Payment Solution (Shopify Payment)
- Logistic Services (MS Direct AG)
- Newsletter Services (Klaviyo)
- IT service provider (hosting services) (Shopify)
We also share your personal data with other Data Controllers. Such Data Controllers may be authorities (Police, tax authorities or other authorities) with whom we are required to share data in accordance with law or as a result of suspected criminal activity, payment providers and banks to facilitate transactions, external advisors (lawyers and auditors) and courts to protect our rights, companies that buy all or part of our operations/assets, and transport companies in order to manage and deliver your order. When your personal data is shared with other Data Controllers, they will be responsible for your personal data and we refer to them for more information about how they process your personal data.
Our Site is powered by Shopify. Shopify collects and processes personal data relating to customers in order to operate the Site and provide its services. Information you submit to the Site may be shared with Shopify and with third-party service providers, including providers located in other countries, for the purpose of operating the Site and providing services to you. Under no circumstances does the Company sell or rent your personal data, including health data, to third parties for their own activities.
6. DOES THE COMPANY PROCESS SPECIAL CATEGORIES OF PERSONAL DATA?
The Company does not process sensitive information such as information about race or ethnic origin, political opinions, religious beliefs or sexual orientation. However, in some cases we are required to collect and process data about health for safety reasons for a limited period of time, such as information about allergies or other health conditions, which we need to know when we are investigating a product complaint, organising travel, training events and similar.
Such data will only be processed after we have received your explicit specific informed consent and will always be deleted as soon as the specific individual purpose for which it was collected is no longer applicable.
7. FOR HOW LONG IS PERSONAL DATA RETAINED?
7.1 When we process personal data is based on an agreement.
We will retain your personal data during the contractual term and delete it when the contract ends. However, the following exceptions apply:
- If we are required by law to retain or disclose any of your personal data after the agreement has been terminated, we will retain the data for as long as and to the extent required by law, (e.g., up to five or ten years under general statutory limitation regime) or as instructed by a court or public authority
- If it is necessary for the establishment, exercising or defence of legal claims, we will retain relevant personal data until it is no longer needed for such a purpose
- Photos or movies will not automatically be deleted upon completion of a certain event but will be used under the terms of our agreement and your individual express consent to the exploitation of your image.
- For purchase agreements, we will process your personal data during the contractual term of our agreement and thereafter during the general statutory limitation period, which may extend up to ten years. We will then delete your personal data, provided that no other exceptions as described above apply.
7.2 We will process personal data based on our legitimate interests:
Events and competitions: We will retain your personal data until the event or competition has been completed (including any evaluation of them). However, photos and videos from the event will not be automatically deleted upon completion of the event but may be used as long as they are relevant for our marketing purposes subject to the terms of our agreement and your individual express consent to the exploitation of your image.
Product questions and complaints: We will process personal data for three years after we have received it, to perform statistical analyses of issues and complaints, to investigate, track and report potential health risks or product problems, to monitor and improve our customer service, pay compensation and to prevent fraudulent behaviour (e.g., unfounded claims for compensation).
Website visitors: We will process your personal data collected through cookies based on your consent and until the relevant cookie expires or you withdraw your consent.
Ideas and similar: We process spontaneously submitted personal data as long as it is relevant to us.
Cooperation/Ambassadors: We will keep your personal data for as long as our informal cooperation continues or your personal profile is relevant to our marketing, until three years after our last contact.
7.3 Where we process personal data based on your consent, we will do so until the consent is withdrawn or for as long as it is necessary for the purposes of the processing of personal data, whichever is earlier.
News updates: We will retain your personal data for as long as you remain signed up for or indicate your interest in our news updates. You may at any time cancel our news updates by opting-out or unsubscribe from our marketing.
Advertising campaigns: We will process your personal data for as long as you are registered to receive advertising, for the purpose of targeting advertising campaigns to you and/or excluding you from such campaigns.
7.4 Note that the above retention periods do not apply to the extent to which the Company is obliged to retain your personal data (partially or in full) in accordance with applicable mandatory law (e.g., accounting legislation) or during the statutory limitation period related to any requirements from you or applying to you.
8. WHAT ARE YOUR RIGHTS AS A DATA SUBJECT?
Subject to the conditions of Applicable Regulations, you have the following statutory rights:
- Right of access: At any time, you may request access to your personal data. Upon request, we will provide a copy of your personal data in a commonly used electronic format.
- Right to correction: You have the right to have incorrect personal data corrected and to have incomplete personal data completed.
- Right to deletion: Under certain circumstances (including processing based on your consent), you can request that we delete your personal data. Please note that this is not an unconditional right. Therefore, an attempt to exercise the right may not lead to a measure from us.

Right to object: At any time, subject to GDPR and applicable local laws conditions, you may object to any processing by us in relation to your personal data. We will then only process your personal data if it can be shown that there are definitive legitimate reasons why the data must be processed, which outweigh your interests, rights and freedoms or if the processing is taking place to establish, exercise or defend legal claims. You always have the right to object to your personal data being used for direct marketing, including profiling. Such an objection can be made at any time. |
- Right to withdraw your consent to the processing of your data (when the processing of your data is based on your consent).
- Right to restriction of processing: Under certain circumstances, you may request that we restrict the processing of your personal data. Please note that this is not an unconditional right. Therefore, an attempt to exercise the right may not lead to a measure from us.
- Right to data portability: You have the right to get your personal data that you have provided to us (or have such personal data transferred directly to another data controller, if technically possible) in a structured, generally used and machine-readable format, in cases where the processing of your personal data is based on consent or in order to fulfil an agreement with you.

The Company undertakes to reply to you as soon as possible, and in any event within one (1) month of receiving your request. If necessary, this period may be extended by (2) two months or longer, where permitted under applicable local laws, taking into account the complexity and number of requests that are addressed to the Company. In this case, you will be notified of the extension and the reasons for the delay.
If your request is submitted electronically, information will also be provided electronically where possible, unless you specifically request otherwise.
In the event that the Company is unable to fulfill your request, you will be informed of the reasons for this.
You will always have the opportunity to lodge a complaint with a supervisory authority and/or to seek legal redress. In particular, if after contacting the Company and despite the Company's efforts, you believe that your rights have not been respected, you may file a complaint with the relevant supervisory authority. 9. COOKIES
As part of our way of providing personalised services on our Website, we use cookies to store and sometimes track information about you.
